§ 1 General

1.1 These are the General Terms and Conditions of:

1.2 Rosenschild GmbH (hereinafter “Rosenschild”) is the publisher and operates the domain “rosenschild.de”, through which limited-edition photo books are offered.

1.3 The following General Terms and Conditions apply to all business relationships between Rosenschild and the prospective customer.

§ 2 Reservation / Conclusion of Contract

2.1 Via the website “rosenschild.de”, the prospective customer may submit a non-binding reservation for the books offered. The reservation does not yet constitute an offer to conclude a purchase contract and does not establish a purchase contract.

2.2 The reservation serves solely to record the prospective customer’s purchase interest and to prepare a later conclusion of contract.

2.3 Rosenschild GmbH, as the publisher of the book and operator of the website “rosenschild.de”, does not become a contracting party to any subsequent purchase contract for the books offered.

2.4 A purchase contract is concluded exclusively between the prospective customer and reuter europe GmbH (Kaistr. 13, 40221 Düsseldorf), subject to the conditions set out in the GTC of reuter europe GmbH. Rosenschild GmbH merely accepts the pre-orders in the name of, or for forwarding to, reuter europe GmbH. The prospective customer’s contracting party with regard to the purchase contract is exclusively reuter europe GmbH.

2.5 The reservation is forwarded by Rosenschild GmbH to reuter europe GmbH. The purchase contract between the prospective customer and reuter europe GmbH is concluded only upon acceptance of the order by reuter europe GmbH, in particular through an order confirmation or the dispatch of the goods.

2.6 All claims arising from the purchase contract, in particular regarding delivery, payment or other contractual rights and obligations, exist solely between the prospective customer and reuter europe GmbH.

§ 3 Final Provisions

3.1 These GTC are governed by the law of the Federal Republic of Germany. The statutory provisions restricting the choice of law and on the applicability of mandatory provisions, in particular of the state in which the prospective customer has their habitual residence as a consumer, remain unaffected.

3.2 Should any present or future provision of these GTC be or become invalid or unenforceable, the validity of the remaining provisions of these GTC shall not be affected. In place of the invalid provisions, the statutory provisions shall apply, where available, provided this would not constitute an unreasonable hardship for either party.
